Hosting

Whilst ‘Design by Jo’ offers website and email hosting, no guarantees can be made as to the availability or interruption of this service and ‘Design by Jo’ cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss.

Where ‘Design by Jo’ has agreed with the Client that ‘Design by Jo’ will provide the hosting;
a) The Client agrees that liability will not be attributed to ‘Design by Jo’ in the event of website downtime or the inability to operate the webpages or website.
b) Where the Client is hosting the site the Client agrees that they are responsible for ensuring that their hosting environment is compatible with the code provided by ‘Design by Jo’.
c) If the client does not use ‘Design by Jo’ hosting services, then the management and hosting of the website and domain name are the Client’s full responsibility.
d) The fee payable to ‘Design by Jo’ for hosting the website will be payable by the Client to ‘Design by Jo’ on a rolling yearly contract.
e) In the event that the Client fails to provide payment for the hosting within 30 working days following the date payment is due ‘Design by Jo’ will suspend their site. We reserve the right to charge an administration fee of £50 for reactivating the website/hosting.
f) In the event that payment is not received and the site is suspended for a period of 60 days or more all files will be deleted and the site will be lost.
g) If the client does not wish to renew the hosting, files and associated data can be made available to the client fee-free on request and the domain name can be transferred to the client’s registrar account.

Web Design

Since 2015, all website design projects designed by ‘Design by Jo’ are responsive and function across all platforms, mobile devices and varying screen resolutions. Web-based content management systems are included as standard enabling you to update your website at any time, with no advanced programming knowledge required. We will give you training on how to add a post or a new page, and will never leave you to cope on your own. We can also update your website for you and are always happy to discuss your needs.

We work using a professional CMS framework and we can also design from templates of your choice which helps to keep the cost down. The framework will be purchased and included in your bill. If you ever want to move the site away from us then you must purchase your own license code to continue using the theme. These are legal requirements required by ThemeForest.

We charge for the design and development of websites at various stages. We will design a site for your approval, working together at all stages. Once the design is approved and the home page is completed, a deposit will be due to confirm our working contract, this usually amounts to 25% or the amount we have agreed via our email discussion. The final payment is payable when the website is complete and ready to ‘go-live’. Your website will only be switched to ‘live’ mode when it has been paid for, in full. The initial deposit payment is non-refundable after ‘Design by Jo’ has committed resources or completed research and/or design work on the client’s behalf.

We offer ‘unlimited design revisions’. This means that we will continue to work with you on your design concept until you are happy with our proposal. The unlimited design revision period ends when the client accepts the design proposal and home page draft. Design changes beyond this point are subject to additional charges.

‘Design by Jo’ shall expect the client to carry out sufficient research before proceeding with a website. This will include checking that the website will operate legally. Please ensure that any images or content you supply or use on your website are legally available for you to use. We cannot be held responsible for the illegal use of images, content or format of material supplied by the client. ‘Design by Jo’ reserves the right to remove any website from its servers if it has reason to believe that may be deemed offensive, illegal or in any way controversial.

In the event of a Webmaster change, site owners are not allowed to display the credits to the new website, unless such time that the website functionality and appearance are changed by over 50% of our original work.
The client may continue to use the commissioned website to promote the client’s company regardless if he/she chooses to continue further services with ‘Design by Jo’. The client does not have the right to resell the design or development to other companies.
The client does have the right to add pages to the existing site or have another company add pages to the existing site using the commissioned website/design development. The client does not have permission to reuse pieces of our work in a redesigned website that gives another company design credit.

Commercial Projects

If you would like to use any of the free downloads provided such as my Photoshop brushes or graphic sets for commercial uses, I accept a donation of £10.00 per set. Please contact us with your intended use before downloading or making a payment.

Privacy Policy

At this site, you can inquire about anything mentioned throughout the site or send your comments. The type of personally identifiable information that may be collected includes name and email address. Our sole purpose for collecting this information is to respond to your feedback or inquiry. We will not disclose or sell your personal data to any third parties.

Hosting and Maintenance Cancellation

A new client’s web hosting contract may be cancelled up to 30 days after the account has been set up, a full refund will given minus an £10 administration fee. After 30 days, neither a full nor partial refund based on the remaining months of a year’s hosting fee can be given.

For existing customers, cancellation of a hosting or maintenance account requires advance notice. Hosting accounts and maintenance accounts require 24-hour notice prior to the first (1st) day of the next billing cycle. Because web hosting services are provided on a yearly basis, the client will be responsible for service fees already paid regardless of when the client provides notice of termination. Thus, for example, if Client provides notice to terminate prior to the end of the billing cycle,  the remaining balance for that month will not be pro-rated or refunded. If Client has prepaid for services twelve (12) months in advance, the client agrees that no refunds will be issued for any unused portion of the services regardless of when the client cancels the services. Therefore, if the client’s account is cancelled at any point during the pre-paid contract term, Client will not be entitled to a pro-rated refund.

All accounts are cancelled as soon as the client submits the account cancellation request, at which time all remaining files in Client’s account will be deleted. ‘Design by Jo’ will not be held responsible for any files deleted by ‘Design by Jo’ on that day. The cancellation procedure is subject to change without notice.

You are welcome to take your site to another host/designer and as always we are happy to help and discuss via email.

Domain Names and Links

If required, a domain name will be registered by ‘Design by Jo’ on behalf of the client once we have received payment in full. Although the domain names are registered to us, the client is the legal owner of the domain and if they request to have details changed or the domain transferred elsewhere, we will do this within a reasonable timeframe.

Domain names require yearly renewal and there is an associated fee for this. Any domain name renewal is the responsibility of the client. ‘Design by Jo’ will attempt to contact the client by email up to 2 weeks in advance of a domain renewal being due. If the client doesn’t pay to renew their domain name, the domain name shall not be renewed.

We place a small text link on the footer of our client’s website that simply states the website was designed by ‘Design by Jo’ and links to our company website. We then link back to your site from ours with a site description and any testimonial you would like to add.

Communication

Email is our primary method of contact with regard to all communication for your website design and development. It is the client’s responsibility to inform us by email of any change in email address so we always have valid contact details. We cannot be held liable in any way for problems relating to communication issues if we are not supplied with a valid email address.

Emails

All emails are to be downloaded on the client’s computer periodically. Email boxes must be kept within their quota limits. Periodical maintenance may be carried out on the email box and emails older than 6 months are deleted.

Clients must not use the email hosting for inappropriate content and other undesired emails which can result in spamming or infecting the server. Under such circumstances, immediate action will be taken and the required files and data will be deleted without any prior notice.

‘Design by Jo’ offers packages in coordination with third-party providers. Changes to the third-party provider’s rules and policies may ultimately affect the services we provide or the terms and conditions herein. Hosting is on shared servers hosted via third-party providers. ‘Design by Jo’ ensures best to our ability that our systems and servers are protected from hackers, viruses, intruders and other online and offline problems, however, we will not be held liable for any disruption of services if such a situation arises.

Please note that ‘Design by Jo’ reserves the right to change the terms and conditions without notice.

Publicly Available Personal Information. We collect first names, last names; email addresses; and other similar data.

We automatically collect certain information when you visit ‘Design by Jo’. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use ‘Design by Jo’ and other technical information. This information is primarily needed to maintain the security and operation of our site and for our internal analytics and reporting purposes. To respond to user inquiries/offer support to users. We may use your information to respond to your inquiries and solve any potential issues you might have with the use of  ‘Design by Jo’.

For other Business Purposes. We may use your information for other Business Purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns, evaluating and improving our Services, and your experience. We may use and store this information in aggregated and anonymized form so that it is not associated with individual end-users and does not include personal information. We will not use identifiable personal information without your consent.

We may process or share data based on the following legal basis:

5. HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

6. HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from ‘Design by Jo’ is at your own risk. You should only access the services within a secure environment.

7. DO WE COLLECT INFORMATION FROM MINORS?

We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of ‘Design by Jo’.

8. WHAT ARE YOUR PRIVACY RIGHTS?

In some regions (like the European Economic Area), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information. If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of the processing before its withdrawal. 9. reCAPTCHA v3

10. DO WE MAKE UPDATES TO THIS POLICY?

We may update this privacy policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible.

Our premium graphics and themes are available to download through Envato Marketplaces. We happily give free support for all purchased files, and can also customize your chosen template for you. Please contact us through our profile page on either ThemeForest or GraphicRiver. Unfortunately, we are unable to reply to any requests sent through this website in regards to our themes due to illegal downloads and unscrupulous people wanting help without first buying our work!

How to purchase items

Step 1: Sign In or Sign Up – In order to purchase an item, you need to be a member of the marketplace and be logged in. If you have previously signed up, simply enter your login credentials at the top of the page and hit the Sign In button. Otherwise, go to the Sign Up page and complete the form. Signing up only takes a minute and you’ll be sent a verification email. Joining one marketplace automatically gives you member access to all Envato Marketplaces. You can contact authors, make comments on items, and participate in the forums too.

Step 2: Purchase – There are two purchase options: Buy Now or Prepaid Credits. Select the option that suits you, and complete the purchase.
Purchases are available through credit/debit card (Buy Now only), PayPal, or Moneybookers.

Step 3: Download Your Item – Simply click My Account at the top of the page, then click Downloads. There you should see a list of all the items you’ve bought. Just click the Download button next to the item to download it.

Support for items includes:
  • Responding to questions or problems regarding the item and its features.
  • General support is offered through the item’s comments.
  • More detailed help is offered through the contact form on my profile page.

Digital Downloads Terms of Use

  1. Payment – All payments are collected and processed through Paypal.
  2. Delivery – After payment download links are delivered automatically to the email associated with the order through Payhip.
  3. Refund – By downloading the files you waive your right to a refund. This is due to the nature of downloaded files. As per Payhip Terms and Conditions Section 2. If you wish to cancel your purchase, please do not download the file, contact us so that we can arrange a refund.
  4. Legal – By purchasing a digital download you agree to the terms and conditions. Each work and its contents are fully covered by UK copyright law.
